Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the EasyAgentIDX platform, websites, embedded widgets, and APIs (the “Services”). By creating an account or using the Services you agree to these Terms. If you use the Services on behalf of a brokerage, agency, or other organization, you represent that you have authority to bind that organization.

2. The Services

EasyAgentIDX provides no-code IDX search and listing experiences that real estate professionals embed on their own websites, plus an optional Developer API and Automated Home Valuations add-on. Access to MLS listing data requires approval from the applicable MLS board; we facilitate the provisioning process but final approval rests with each MLS.

3. Accounts and Eligibility

• You must be a licensed real estate professional, or authorized to act on behalf of one, to connect MLS data
• You are responsible for the accuracy of the license, brokerage, and office information you submit during MLS provisioning
• You are responsible for all activity under your account and for keeping credentials secure
• Team members you invite are bound by these Terms; you are responsible for their compliance

4. Subscriptions and Billing

• Plans are billed in advance on a monthly basis through Stripe. There are no annual or yearly billing options
• Each new MLS board connection carries a one-time $99 setup and approval fee, plus any board-specific fees disclosed at checkout
• Board-specific pass-through fees are set by the MLS or data partner and may change; we will notify you before any such change takes effect
• For IDX plans: payments are non-refundable once MLS approval has been completed. MLS approval, activation, data-provider, and other third-party costs begin when an order is processed and cannot be recovered. The only exception is when the MLS approval process cannot be completed and your service cannot be activated. In that situation a refund is issued. No refund is issued for unused subscription time after cancellation, except where required by applicable law. See our Refund Policy for full details and how to request a refund.
• Automated Home Valuations (AHV) add-on payments are non-refundable once activated. Data-provider costs begin immediately upon activation and cannot be recovered.
• If payment fails, we retry per our dunning schedule. Accounts that remain unpaid may be suspended, and MLS data delivery stops immediately upon cancellation as required by MLS rules
• You may cancel at any time; service continues through the end of the current billing period

5. MLS Data Restrictions

MLS listing data is licensed, not sold. You agree to:

• Display MLS data only on websites and applications approved during provisioning
• Preserve all required attribution, disclaimers, and compliance notices rendered by the Services
• Not scrape, bulk-export, resell, or redistribute MLS listing data
• Not remove, alter, or obscure listing broker attribution
• Not use listing data to train machine-learning models or build derivative data products
• Comply with the rules of each MLS board connected to your account, which may impose additional restrictions

Violations of MLS rules may result in immediate feed suspension by us or by the MLS, without refund.

6. Prohibited Uses

• Reverse engineering, probing, or disrupting the Services
• Circumventing rate limits, domain validation, or authentication
• Submitting false or fraudulent lead information
• Using the Services to send spam or unsolicited communications
• Reselling access to the Services except as expressly permitted under an Agency plan
• Any use that violates applicable law or MLS rules

7. Your Content and Leads

You retain ownership of the content you provide and the leads captured through your widgets. You grant us the limited rights needed to operate the Services, for example storing lead records, delivering notifications, and displaying your configuration. You are responsible for complying with applicable laws (including consent and telemarketing laws) in how you contact your leads.

8. Developer API

API access is available on eligible plans and is subject to rate limits, scope restrictions, and the MLS data restrictions above. API credentials are confidential; you may not share them or embed them in client-side code. We may suspend credentials that exhibit abusive usage patterns.

9. Availability and Changes

We work to keep the Services available and performant, but they are provided “as is” without warranty of uninterrupted availability. Listing data freshness depends on MLS feeds and provider availability. We may modify features with reasonable notice for material changes.

10. Limitation of Liability

To the maximum extent permitted by law, EasyAgentIDX will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Services. Our total liability for any claim is limited to the amounts you paid us in the twelve months preceding the claim.

11. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms or MLS rules. Upon termination, MLS data delivery stops immediately, embedded widgets enter a disabled state, and we retain records as required for legal and compliance purposes.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the dashboard or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
